Probate is the legal proceeding whereby an estate is transferred on death. The process is complicated, time consuming, and frustrating—during an already emotional time. • Trust Administration
While a trust is administered out of court, formalities are still important to protect both the trustee and the beneficiaries. A trustee must comply with state law, work with financial firms, manage and inventory assets, and finally distribute assets to beneficiaries. Our office can manage those tasks for the trustee while protecting the trustee from liability.
Conservatorship is the legal authority to make medical and/or financial decisions for an adult who lacks the capacity to do so for themselves. It may also be appropriate for an adult with limited capacity who is vulnerable to undue influence or fraud regarding their financial affairs.
The court supervises the conservator, who is responsible for reporting to the court as well as honoring the conservatee’s wishes and best interests. Our office is experienced in assessing whether conservatorship is necessary, petitioning the court, and assisting conservators following appointment.
